This template affidavit of nonmilitary service may be used in Florida state courts to obtain a default against a defendant. Without this affidavit, the court will not enter default, as you generally cannot secure a default against someone in the military. See Servicemembers Civil Relief Act, 50 U.S.C. § 3931 (providing protections for servicemembers, including eviction protection). This template includes practical guidance, drafting notes, and an optional clause. In Florida, an affidavit is a written declaration under oath. Fla. Stat. 92.50(1). Florida requires an affiant to sign the document before a notary, as opposed to a declaration that can simply be signed under penalty of perjury. You may substitute an affidavit with a sworn declaration. See Fla. Stat. 92.525(1)(c). For related templates, see Affidavit (FL) and Declaration (FL).
